Jury: Alicia Lewie Guilty Of Manslaughter In Son’s Death

QUEENSBURY – In a what became a bizarre trial and is certain to be headed for an appellate review, a Warren County jury has found Alicia Lewis guilty of all charges for her role in the beating death last fall of her 7-month-old son by her roommate.  

Alicia Lewie, 23, of Greenwich, was convicted Thursday of two counts of second degree manslaughter, one count of first degree reckless endangerment and endangering the welfare of a child. Lewie’s roommate, Michael Flint Jr., 23, has pleaded guilty to second degree murder in the death of Lewie’s 7-month-old Colbi Bullock and is in Warren County Jail awaiting sentencing on June 4. Flint has admitted slapping, biting and choking the infant over the course of two days while babysitting the infant at the Bay St., Glens Falls, apartment he and Lewie shared. The baby died Nov. 14 in Albany Medical Center following his removal from respirators which had been keeping him alive.

Lewie was charged with manslaughter because authorities said she failed to act as a mother to her baby, leaving him in the care of Flint whom she knew had a history of physical violence, and failed to get him treatment.

Lewie faces up to 15 years in prison at sentencing on June 19. She had refused a plea deal that would have sentenced her to 10 years in prison.

Hall immediately revoked her bail following the verdict and sent her to the Warren County Jail.

The verdict came about 4 p.m. on the third day of deliberations and after the jury had earlier in the day told Warren County Court Judge John S. Hall that it was deadlocked on one of the manslaughter charges. Hall had told them to continue deliberating.

The jury had said that it had reached a verdict on three of the four charges but was hung up 9-3 on one of the manslaughter charges which accused Lewis of not expediently seeking medical care for her son.

Lewie’s attorney, Michael Keenan, had moved for a mistrial after a female juror sent a note to the judge, telling him her personal problems and asking if he could provide her with the name of a divorce attorney. She then asked Hall for the phone number and contact information for “the hottie sitting next to Ms. Hogan”, assistant district attorney Matt Burin.

After a sidebar conference with the attorneys, Hall adjourned to chambers for a conference between the lawyers and the juror. Keenan’s mistrial motion was made in chambers rather than in open court and was denied by Hall. 5-15-08
