Asbestos Contractor Accused Of Insurance Fraud

WESTCHESTER COUNTY—An asbestos removal contract has been arrested for misrepresenting that his company had valid workers compensation insurance when it did not.
Jose Montas, 31, of 27 Butler Place, Yonkers, has been charged with second degree forgery and two counts of violating the state Workers’ Compensation Law.
Prosecutors say Montas altered a New York State Insurance Fund Certificate of Workers’ Compensation Insurance covering the period from Nov. 18, 2007 through to Nov. 18, 2008, by inserting a false time period, as well as altering the certificate number.
The certificate misrepresented the fact that Montas and his company, All State Environmental Corporation of Yonkers had valid workers’ compensation insurance.
The certificates also contained a fraudulent certificate number as it related to the defendant and his company.
Additionally, in having a business that employed more than five employees and not having Worker’s Compensation Insurance, recently became a felony offense.
Montas’ bail was set at $5,000. His next court date is Sept. 23. If convicted, he faces a maximum of two and one half to seven years in state prison on the top charge. 8-19-08
