Ex-Sheriff Denies Sexual Harassment, Discrimination

QUEENSBURY—Any sexual harassment or discrimination experienced by two female correctional officers of the Warren County Sheriff’s Department was their own fault although he denies that any discrimination or sexual harassment existed during his tenure as a public officer.
So says former Warren County Sheriff Larry Cleveland.
Cleveland has filed his answer to the $10 million claim filed against him, the county and sheriff’s department by two veteran female correctional officers for sexual harassment and discriminatory promotion and job assignment practices.
In 14 affirmative defenses, Cleveland says the claim should be dismissed because any damages caused were by the plaintiffs’ own “culpable conduct” and that none of the defendants possessed actual or constructive knowledge of the sexual harassment which the women say they experienced.
Michelle LeBarron and Cynthia VanDenburgh, both of Queensbury, filed suit in U.S. District Court in Albany in May after having initially filed charges in March 2005 under Title VII and the Human Rights Law with the Equal Employment Opportunity Commission alleging, among other things, that they were discriminated against due to their sex and that they were subjected to sexual discrimination, sexual harassment and inappropriate conduct by Cleveland and the county.
