Penis Pump Judge Faces DUI Charge

TULSA, OK—Former Creek County District Judge Donald Thompson who was released from prison in April for his conviction of indecent exposure as a result of masturbating on the bench during trials is under arrest again, this time for drunk driving.
Thompson, 62, also known as the penis pump judge, was arrested by an Oklahoma Highway Patrol trooper about 3 a.m. Friday. According to a police report, the trooper came upon a vehicle that was stopped on the outside shoulder of the Creek Turnpike. The car had a flat tire and damage to the driver’s side.
According to the report, the trooper said that the driver, identified as Thompson, had slurred speech, bloodshot eyes and a strong odor of alcohol on his breath. Thompson told the officer that he didn’t know how the car had sustained damage. It was later determined that Thompson had struck a wall.
Records indicate that Thompson’s BAC was 0.11, well over the legal threshold of 0.08. He was booked into the Tulsa Jail and later released after posting $1,000 bond.
Thompson, married and the father of three adult children, was convicted in September 2006 for using a penis pump while presiding over four trials in 2002 and 2003. He was sentenced to four, one year sentences in state prison, to be served consecutively, and fined $40,000. He is a registered a sex offender with the Oklahoma Corrections Department and the Sapulpa Police Department.
Thompson served 20 months of a four year sentence. He was disbarred in September.
The former judge had claimed the penis pump was a gag gift on his 50th birthday from a friend and despite eyewitness accounts, including police officers, he claimed he never used it.
A former court reporter testified during Thompson’s trial that she had seen Thompson’s penis “12 to 15 times” during trials. Thompson had fired the court reporter in 2004 after she testified before a state judicial commission about his alleged use of the penis pump in the courtroom.
Another court reporter who had recorded proceedings of one of Thompson’s trials in September 2003, testified that she had seen Thompson use hand lotion and fondle himself during the trial.
Thompson, a former state legislator, had been a judge for nearly 23 years before he retired in 2004 amid the allegations. His attorney had admitted that Thompson had purchased another penis pump after a doctor who was treating him for erectile dysfunction and other medical problems had recommended it.
Thompson is trying to get his retirement benefits reinistated. His attorney argued for reinstatement at a recent administrative hearing and a decision is expected in January.
The Oklahoma Public Employees Retirement System revoked his benefits after he was convicted in 2006 of using a penis pump while adjudicating trials during 2002 and 2003.
Thompson is claiming that he didn’t violate his oath of office and that he is entitled to the benefits which amount of $7,789 a month. If it is found that he did violate his oath, his attorney says his benefits should be revoked only for the term of office when the incidents occurred, not his entire tenure in office. Under that situation, Thompson would receive $6,649 a month, about $1,100 less. 12-06-08
