SUFFOLK COUNTY—A Suffolk jury acquitted a Commack man of first degree sexual abuse and endangering charges Friday after a near month-long trial in Suffolk County court in Riverhead.

Marc Pipitone of 93 Fulton Boulevard in Commack was indicted in April of last year for the alleged sexual abuse in 2007 of a five-year-old non-verbal autistic child and his seven-year-old brother.  He was also charged with aggravated harassment for sending threatening emails to a friend of the victims’ family.  The jury convicted Pipitone of two counts of aggravated harassment for sending the emails.

The defendant, who had worked as a substitute special education teacher in the Smithtown and Deer Park school districts, was caring for the children as a respite care aide.

The trial began Sept. 21.

Pipitone will be sentenced for the aggravated harassment misdemeanor charges on Dec. 11.  10-16-09
