Court Disciplines Glens Falls Attorney

GLENS FALLS—A Glens Falls attorney has been suspended from practicing law for a period of three years by the Appellate Division of state Supreme Court for a plethora of ethics violations.
The Committee on Professional Standards (COPS) found that Daniel J. Gallagher of Toomey & Gallagher of Glens Falls, formerly of Newell & Toomey, had neglected a number of client matters, attempted to mislead and deceive several of the clients as to the status of their mattes and attempted to mislead and deceive COPS as to two of the client matters.
It was found that Gallagher, who was admitted to practice law in 1994, failed to comply with trial court directives in one client matter, failed to respond to communications, failed to promptly refund the unearned portion of retainers or forward client files on discharge.
The court stayed the suspension contingent on conditions which include him having to enroll in the NYS Bar Association’s Lawyer Assistance Program by executing a sobriety monitoring contract, file semiannual reports with COPS from his medical provider, not be the subject of any further disciplinary actions. He must also complete two credit hours of accredited continuing legal education in ethics and professionalism and two credit hours in matrimonial practice.
