KEENE VALLEY—An 18-year-old Keene Valley man is facing felony rape and burglary charges for allegedly breaking into the Keene Valley Central School in order to have sex with a 12-year-old girl.

Kyle J. Kernan-Dudley was arrested Wednesday and charged with first degree rape with a victim less than 13 years of age and third degree burglary, both felonies.  In addition, he has been charged with second degree sexual abuse and endangering the welfare of a child, both misdemeanors.

State Police said that Kernan-Dudley and a 12-year-old girl illegally entered the school building about midnight on both Nov. 20 and 21, in order to have sex.  Police said they gained entry through an unlocked window.  Both are reportedly students at the school.

There are no allegations that the sexual contact was forced but that the girl could not legally consent.  In New York, the age of consent is 17.

Kernan-Dudley was arraigned in North Elba Town Court and released on $2,000 bail.  His next court appearance is set for Monday in the Keene Town Court.   11-27-09
