MAHOPAC---A Mahopac man has been indicted for illegally operating a landfill on the grounds of the Eastchester Middle School/High School.
The defendant, Anthony Adinolfi, 46, was arraigned Wednesday in Westchester County Court before Judge Richard A. Molea and charged with a felony violation of the Environmental Conservation Law. If convicted, Adinolfi faces up to four years in state prison and fines of up to $75,000 per day of violation and restitution. Adinolfi pleaded not guilty to the charge and bail was set at $7,500.
Adinolfi was the president and sole shareholder of the now dissolved corporation Dirt Man Enterprises, Inc. In October 2002, Adinolfi entered into an agreement with the Eastchester Union Free School District to enlarge an athletic field in exchange for permission to bring dirt and rock to the school. However, it is alleged that, instead delivering dirt, Adinolfi illegally arranged for others to dump construction and demolition debris on the field, and even charged a fee to those who dumped at the site.
The indictment alleges that, as a result of these actions, from Jan. 9, 2003 to July 21, 2003, Adinolfi operated a landfill at the Eastchester High School without the necessary DEC permit, causing the release of more than 70 cubic yards of solid waste into the environment. In accordance with the Environmental Conservation Law, Adinolfi was charged with a felony because he had been convicted of a similar offense. 6-22-06
