Police said the victim was a 22 year old female who resided at the facility. Her name was not be released because Florida Statutes prohibit the release of information concerning the victim of a sexual battery.

In their ongoing investigation of Rosalie Manor, the Pinellas County Sheriff's Department determined than Dungan and the victim were residents at the facility in March of 2005. Police say that Dundan admitted Tuesday that he had given the woman 19 pills of his prescribed hydrocodone and then assaulted her. She died hours later on March 10, 2005

On March 10, 2005 detectives conducted a death investigation after they were notified that the victim had been taken to Mease Dunedin Hospital in cardiac arrest. On April 13, 2005 the Medical Examiner ruled that the victim's death was a result of hydrocodone toxicity.

In December 2005, deputies began a review of criminal cases. As part of the review, deputies reopened the March 10, 2005 death investigation. On July 14, deputies interviewed Anderson who told deputies that Dungan gave the victim hydrocodone tablets and that Dungan had a prescription for hydrocodone.

Deputies contacted Dungan and transported him to the Sheriff's Office North District Station. During the interview deputies say Dungan acknowledged some responsibility in the death of the victim and indicated he gave her some hydrocodone tablets. 7-19-06
