The following letter to the editor raises some serious concerns about the safety of disbarred attorney and judicial whistleblower Elsebeth Baumgartner of Oak Harbor, Ohio who is currently incarcerated in the Erie County Jail in Sandusky, Ohio. She is scheduled to be transferred to the Cuyahoga County Jail for a surprise hearing on Sept. 28 in Cleveland before Cuyahoga County Common Pleas Court Judge Shirley Strickland Safford. In an interview with The North Country Gazette Sunday evening, Baumgartner said she has not been served with any papers regarding the hearing nor does she know its purpose. When Baumgartner had been transferred from the Erie County Jail to Cuyahoga County Jail on Sept. 12 for the trial scheduled to have begun Sept. 13 before Saffold and multiple intimidation and retaliation charges on complaint of retired visiting judge Richard Markus and her former business partner Bryan DuBois and his wife, Saffold had reportedly said she was unaware of Baumgartner's jailing in Erie County and concurred with Baumgartner that she couldn't be held without formal charges, charges which have still not been filed although she's been incarcerated since Aug. 21 after retired visiting judge Richard Knepper revoked her bond in Erie County Common Pleas Court.
"Had a chance to review the case file for Else Baumgartner in Cuyahoga County as you reported. It's amazing how Bryan's (DuBois) other charges were diverted and closed when they strong-armed him to shut Erie Voices down with Else's involvement yet they continue to maintain a joinder in a remaining open case against him. http://www.northcountrygazette.org/articles/092306SurpriseHearing.html
"Outside of a CYA tactic, do you think Saffold now figures that she may be a witness and called to explain her role in all of this? If I read this right, she knew good and well that Elsebeth was jailed by the way the previous transport warrant from Erie County is worded. How can Saffold disregard the true facts and proceed like (retired visiting judge Richard) Knepper's confinement order is moot to her bring Else back to Cleveland for a second time this month? Kasaris's unavailability is suspect as far as the court docket is concerned. Was Kasaris responsible? Do you think Saffold took it upon herself to generate the expedited docket order to bring Else in on Thursday to recuse herself from the case?
"Like the last time it will probably be under the cover of darkness. Her husband or someone should be there to photograph Else when she leaves Sandusky jail. If these people are that po'd, could it might be the last time anyone will have seen Elsebeth Baumgartner for the last time alive. They have 90 minutes to make up their minds to do harm to her.
"I know that is overly disconcerting but in reality at this point, Else's safety should be of utmost importance. Look at the security measures law enforcement uses to transport and move defendants in and out of courthouses who are known killers. She's already had deputies attack her in a courthouse while trying to file paperwork while judges looked the other way.
"Then again, did these thugs conduct another secret grand jury and Else is being brought back to Cleveland to face more charges because of the Olemacher case? It doesn't take over a month to figure what charges the DA can file. All Knepper had to do was do what Markus did, file a complaint. It worked the first time for Markus. What was Knepper afraid of, that he might wind up in the same meat grinder as Markus? It looks like they forced Saffold into their conspiracy to violate Else's civil rights. Since Saffold denies being part of the proceedings against Else in revoking her pharmacology license, how can Saffold continue to stay in the case and perpetrate this fraudulent persecution? I would hope Saffold has some redeeming quality but I fear not.
"The jurisdiction of these cases is far removed from set case law in my opinion. The lack of notice for charges and hearings is beyond belief. It appears the outside world has obtained more information than what is being made available to Else and she is in custody in "their system." I know you report the facts as they come to you but all we get is more questions than answers each and every time Kasaris and the court makes a move.
"I hope the DOJ or some elected legislative official has taken notice of Elsebeth's circumstances (and has said, "enough is enough") to lead to this upcoming surprise hearing on Thursday.
"What is Else supposed to say if and when she is released, "You won't believe how I spent my entire summer?" I think not but then again, it is aggravating to continue to know that she is suffering in a horrendous way and these Ohio 'dictators of the courts' don't give a damn about repressing her constitutional rights by telling the public to got to hell.
"I wish there was a more cohesive force across the country to free Elsebeth. Look what happened to Terri Schaivo. Let's pray it's not Government 1 and Baumgartner 0.
