Former Warren County district attorney H. John Hendley has pleaded guilty to a non-criminal charge of driving while ability impaired after being arrested in July on a misdemeanor charge of driving while intoxicated after he tried to force his way into a closed Queensbury restaurant.
Hendley's case had been transferred by Warren County Court judge John S. Hall to the catch-all court of Glens Falls City Court from Queensbury town court. He had been arraigned by Queensbury town justice Michael Muller.
The former DA was fined $300, had his driver's license suspended for 90 days and is required to attend a victims impact panel for drunk drivers.
He had been arrested July 7 by State Police in the parking lot of Carl R's café on Corinth Road near Northway Exit 18.
Police has been called about midnight to the restaurant after employees and witnesses said Hendley repeatedly tried to gain entrance to the closed restaurant and then refused to leave when he was told it had closed several hours earlier.
Police said Hendley then sat in his black Cadillac in the parking lot for over an hour, refusing to exit until he was convinced to do so by State Police Sgt. Matt Murray. He was then tested and arrested.
Hendley served two terms as district attorney during the 1980's, defeated in the 1989 contentious election by William E. Mongtomery III.
Robert Winn, Washington County district attorney, was the special prosecutor in the case and said the reduced charge was the standard disposition for a first time offender. Hendley was represented by Glens Falls attorney Joseph Brennan. 9-26--05
