TOLEDO---Ohio Supreme Court Justice Alice Robie Resnick, who pleaded guilty in 2005 to drunk driving, refused to take a breathalyzer test and attempted to flee the Ohio Highway Patrol, has been fined $20 plus costs after pleading guilty to failing to control her vehicle earlier this month, crossing over several lanes of traffic in her Cadillac Escalade and striking another vehicle nearly head-on.
Resnick, 67, had been scheduled to appear in Toledo Municipal Court Monday on the traffic ticket but entered a signed guilty plea on Sept. 14, the day following the accident. She was fined $20 and paid court costs of $78.
Police reports say alcohol and drugs didn't play a role in the accident but no field sobriety tests were given. The road was reportedly wet at the time of the accident.
The driver of the other car, Barbara Holmes, 74, of West Toledo, was injured.
Resnick was not hurt and was transported to her home from the scene by a police officer.
Resnick had tested 0.216 in field sobriety tests, nearly three times the state limit and refused to take the official breathalyzer when arrested for drunk driving in 2005. State law mandates that drivers whose blood alcohol contest registers over 0.17 who refuse to take the test face mandatory jail time. She was sentenced to complete a three day alcohol intervention program in lieu of jail time, paid a $500 fine and surrendered her drivers license for six months, saying she'd suffered a relapse after 22 years of sobriety.
Resnick announced in January that she will not run for re-election to a fourth term. 9-26-06
