A Brooklyn woman has been indicted for assaulting her husband and then tossing his dog out the window of their sixth floor apartment, killing the animal instantly.
Diane Garber, 39, has been indicted on charged of aggravated cruelty to animals; overdriving, torturing and injuring animals; attempted assault in the second degree; assault in the third degree and criminal possession of a weapon in the fourth degree.
If convicted, she could face a maximum of two years in prison.
According to the Kings County district attorney's office, on Sept. 12, inside of their 85th Street apartment in Bensonhurst, Diane Garber and her husband, Bernard Garber, who are in the process of separating, got into an argument. Diane Garber then allegedly flew into a violent rage, punching and scratching her husband. She allegedly smashed the television with a hammer and threw the television at her husband and then allegedly hit him with the hammer.
Prosecutors said that after assaulting her husband, Garber turned her fury toward her husband's dog. She picked the dog and threw it out the window, killing it instantly. She then went downstairs, wrapped the dog in a blanket and deposited him in the apartment building's dumpster. Her husband called police who placed her under arrest. 9-28-05
