Jail Guard Sentenced For Sex With Inmates

TROY---A Rensselaer County corrections officer who pleaded guilty in March to state charges of raping female inmates at the county jail between March and September 2005 has been sentenced to one to three years in state prison on two counts of third degree rape.

David Rohrmiller had also faced federal charges related to abuse of female inmates at the Rensselaer County Jail and has been sentenced to eight years in prison for lying to a grand jury and to the FBI.

Rohrmiller did not forcibly rape the inmates but by law, an inmate cannot legally consent to sex acts with a corrections officer. One of the victims has filed a lawsuit against the county.

The sentences will run concurrently. He will serve three years of post-release supervision and is required to register with the state Sex Offender Registry.

Rohrmiller, who had been a corrections officer for five years, apologized to Judge Robert Jacon.

In 2003, Rohrmiller and two other officers were accused of beating an inmate in his cell. After the other two were acquitted of misdemeanor assault charges at trial, the charges against Rohrmiller were dropped.
