COLONIE-A staff attorney for the Town of Colonie is under arrest, charged with felony assault and unlawful possession of a weapon following a road rage incident in which he allegedly struck a pizza deliveryman in the head with a flashlight.
David Brickner, 46, allegedly struck Kyle Brino, 21, twice in the head with a heavy Mag-light flashlight after a road rage incident on Albany-Shaker Road near Everett Road. Brickner, whose 16-year-old son was a passenger in his car, claims that Brino was tailgating him. He told police he and Brino both stopped their vehicles on Traditional Lane where Brickner resides and all three got out.
Brino says that the teenager pushed him up against his car and Brickner struck him twice in the head with his flashlight. Brickner says that Brino grabbed him around the neck which is why he struck him with the flashlight. 11-21-06
