ALBANY---The son of Lt. Governor Mary Donohue has been arrested for drunk driving.
Justin Donohue, 18, was charged with driving while intoxicated and speeding about 12:30 a.m. Wednesday after State Police came upon a 2005 BMW in a ditch on Sweetmilk Creek Road, Brunswick.
The legal drinking age in New York State is 21.
According to State Police, Donohue failed a field sobriety test and blew a .16, double the state's threshold for intoxication, when he was given a breathalyzer at the Brunswick State Police station.
Donohue has reportedly attended a party Tuesday night at 1027 Cloverlawn Road in Brunswick. State Police had broken up the party and Joseph Marchese, 18, a resident at that address, was arrested for alcohol possession.
Donohue is scheduled to appear in Brunswick Town Court on Dec. 13.
Lt. Governor Donohue issued a statement saying, "This is a very serious matter that will be answered to in court and handled privately by the family. He is deeply sorry and we are grateful that nobody was harmed due to his actions."
The Lt. Governor has been nominated by Gov. George Pataki for appointment to a federal judgeship but that appointment could be in jeopardy with the Democratic takeover of the U.S. Senate who would need to confirm her appointment. Pataki could appoint her to the state Court of Claims, a nine-year term which pays $136,700 annually.
Prior to becoming Lt. Governor, Donohue was the Rensselaer County district attorney and a state Supreme Court judge. 11-22-06
