TEXAS---The family of man who died attempting to avoid a flying Porta Potti is suing the sanitation company whose truck was carrying the portable toilet.
Michael Eugene Johnson, 34, of Grand Saline, Texas was riding his motorcycle on Highway 16 in Custer, Texas last August. As he tried to pass a sanitation truck carrying a portable toilet, a strap holding the toilet reportedly broke, causing the toilet to fall from the truck, allegedly striking Johnson and causing his motorcycle to slide into the path of three oncoming cars.
The lawsuit contends that the toilet was improperly secured and that the company's negligence caused Johnson's death. According to police reports, the driver of the truck was cited for a "sifting load" but the attorneys for Johnson's family said it should have read ….uhhh…."shifting load".
So far, the defendants haven't filed any response to the lawsuit. 12-26-05
