CLINTON----Facing charges that he attempted to have the case of a family member steered to a particular judge, Clinton Town Justice Daniel L. LaClair has resigned and agreed to never seek or accept judicial office in the future.
The state Commission on Judicial Conduct had served LaClair with a formal complaint alleging that in August 2004, after being contacted by a state trooper who had arrested the judge's first cousin, once removed, LaClair had directed the arrested officer to file the charges in the Ellenburg Town Court which did not have jurisdiction in the matter.
The judicial panel said that LaClair then contacted Ellenburg town justice Dennis LaBombard to inform him that charges against his relative would be coming before Bombard. http://www.scjc.state.ny.us/Determinations/L/laclair,_daniel_(2).htm
LaClair, who had served as town justice for 16 years, did not answer the commission's complaint and submitted his resignation effective Nov. 8.
The judge had been censured by the commission in August 2005 for having requested favorable treatment from two other judges on behalf of his wife and a friend who had been issued speeding tickets. 12-28-06
