TerriPAC Files Amended FEC Reports


Two amended reports have been filed with the Federal Election Commission by TerriPAC, the political action committee of which Florida nurse Michael Schiavo bills himself as chairman.

On Dec. 1, the FEC had sent three letters to Brian Schiavo, Michael's brother, who is listed as the treasurer for the PAC which was formed in December 2005 with the purpose of "holding politicians accountable", especially Republicans who had tried to save the life of Schiavo's brain injured wife, Terri Schindler Schiavo. http://www.northcountrygazette.org/articles/2007/010307SchiavoPAC.html

Terri Schiavo died March 31, 2005, 13 days after her feeding tube was removed by order of probate court George W. Greer.

The FEC had imposed a deadline of Jan. 2 to receive a response to their inquiries regarding campaign disclosure forms filed by TerriPAC but as of Jan. 3, the FEC website indicated that no response had been filed.

As of Friday, the website shows that two amended reports were filed on Jan. 2, one amending the third quarter report which had been filed Oct. 27 and another amending the pre-general report filed on Nov. 1. http://images.nictusa.com/cgi-bin/fecimg/?C00417576

Although the FEC had requested Schiavo and TerriPAC to clarify its multicandidate status in regard to Colorado Congressional candidate Angie Paccione, the amended reports still do not disclose the contribution that Schiavo claims was made to Paccione on July 12, 2006. FEC had advised Schiavo to amend TerriPAC's report and to disclose the five federal candidates that TerriPAC claimed to have contributed to as well as to provide the correct date for meeting the qualification requirements to attain multicandidate status. http://images.nictusa.com/cgi-bin/fecgifpdf/

The statement of organization amendment filed by TerriPAC with the FEC on July 15, 2006, signed by Brian Schiavo, states that contributions had been made to five federal candidates as of that date, including to Paccione.

The amended report shows contributions to six federal candidates, but none to Paccione as previously claimed and the other information which had been requested by FEC is not shown. http://images.nictusa.com/cgi-bin/fecimg/?F27930010372

The amended reports are still improperly prepared in regard to the monetary summaries. Although requested, the PAC has still failed to disclose the identification of all contributors as required with many of the occupations and employers of some of the contributors still not provided as required.

"Commission regulations require a committee disclose the identification of all individuals who contribute in excess of $200 in a calendar year. Identification is full name, mailing address, occupation and name of employer. Your report discloses contributions from individuals for which the identification is not complete", FEC told Schiavo on Dec. 1. And it's still incomplete on the "amended report".

"You must provide the missing information or if unable to do so, demonstrate that "best efforts" have been used to obtain the information, providing the commission with a detailed description of the procedures used".

There are multiple blanks where information should have been provided and TerriPAC failed to provide the FEC with a detailed description of the procedures used to supposedly attempt to learn the information.

Although FEC had questioned the administrative expenses of TerriPAC such as rents, utilities and other operating expenses, the "amendments" still do not make such disclosures. The FEC had told Schiavo that if these expenses were being paid by a "connected organization", the statement of organization must be amended to show the relationship. In-kind contributions must also be disclosed. The third quarter report, as the other quarterly reports, fails to list any rent or operating expenses such as utilities.
