Warrensburg Mother Indicted On 8 Counts Statutory Rape

WARRENSBURG---A Warrensburg woman who was arrested on statutory rape charges after seeking child support for the underaged father of her child been indicted on eight counts of statutory rape.

Kimberly A. Baker, 22, of Warrensburg, was first arrested in early October after going to Warren County Family Court in an effort to make the father of her infant pay child support. During an investigation, it was learned that the father of her two-year-old child was only 13 years old when he had sex with her.

Baker filed petitions with the court admitting to having sex with the teen, now 16. In New York State, a person cannot legally consent to sexual relations until age 17.

Two weeks after her first arrest, Baker was arrested again, this time after a police investigation revealed that she had allegedly had sex with a 14-year-old.

She now faces eight counts of third degree rape, six for the 14-year-old and two for the younger teen. She has also been charged with four misdemeanor counts of endangering the welfare of a child.

She was arraigned Wednesday before Warren County Court Judge John S. Hall remains free. She could face up to four years in prison on each rape count if convicted.

Baker is being represented by attorney Walter Law who says that she has a severe alcohol problem and has completed an inpatient treatment program. Law said that she has been unable to get into other alcohol treatment programs because of the sex charges pending against her. 3-15-07
